Acceptance of These Terms01

These Terms & Conditions govern access to and use of the NestByEllis website. By browsing the site, creating an account or sending a request through it, you agree to be bound by these terms.

If you do not agree with any part of these terms, please stop using the site.

What the Site Provides02

NestByEllis offers information about home warranty plans and a way to request one. A home warranty is a service contract that addresses the repair or replacement of listed home systems and appliances that fail through normal wear.

A home warranty is not an insurance policy. Content on the site is general information and does not replace the written agreement issued for a plan.

Eligibility03

To use the site you must:

  • Be a resident of the United States
  • Be at least eighteen years of age
  • Have the legal capacity to enter into a binding contract
  • Provide details that are true, current and complete

Accounts and Submitted Information04

When an account is created, you are responsible for keeping the password private and for all activity that takes place under that account.

NestByEllis may suspend or close an account that contains false details or that is used in a way that breaks these terms.

Plans, Agreements and Fees05

Coverage begins only once a plan agreement has been issued and any required payment has been received. The agreement states:

  • Which systems and appliances are covered
  • The limits that apply to each covered item
  • The service fee owed for each contractor visit
  • Any waiting period, exclusions and cancellation steps

If anything on the site differs from a plan agreement, the plan agreement controls.

Text Messages and Other Communications06

By giving a phone number and choosing to receive texts, you agree that NestByEllis may send service and promotional text messages to that number. Consent to receive texts is not a condition of purchase.

  • Message frequency varies
  • Message and data rates may apply
  • Reply STOP to end text messages at any time
  • Reply HELP for assistance

Mobile carriers are not liable for delayed or undelivered messages.

Acceptable Use07

You agree not to:

  • Use the site for any unlawful or fraudulent purpose
  • Submit details that belong to another person without permission
  • Attempt to disrupt, probe or gain unauthorized access to the site
  • Copy or collect site content through automated tools

Intellectual Property08

All text, graphics, logos and page designs on the site belong to NestByEllis or its licensors and are protected by applicable law. They may not be reproduced, distributed or reused for commercial purposes without written permission.

Disclaimers and Limits on Liability09

The site is provided as is and as available, without warranties of any kind, to the fullest extent the law allows. NestByEllis does not promise that the site will be free of errors or interruptions.

To the fullest extent the law allows, NestByEllis is not liable for indirect, incidental or consequential losses that arise from use of the site.

Disputes and Arbitration10

Any dispute connected to the site or these terms will first be raised informally by contacting NestByEllis. If the dispute is not settled that way, it will be resolved through binding individual arbitration instead of in court, except where the law does not permit this.

Claims may be brought only on an individual basis and not as part of a class or representative action. These terms are governed by the laws of the State of Ohio.

Changes to These Terms11

These terms may be revised from time to time. The updated version takes effect when it is posted on this page, and the date shown at the top of the page will change to match. Continued use of the site after a revision means the revised terms are accepted.
